Booking Terms & Policies

These terms apply to portrait services provided under the A Poet’s House brand by A POET PHOTO HOUSE (Registration No. SA0654231-T).

1. Reservation

A date is not reserved by an enquiry alone. A booking is confirmed only after the studio accepts the collection and date, the client accepts these terms, and the 50% reservation deposit is received by bank transfer.

2. Deposit and remaining balance

Bank-transfer instructions are provided manually after consultation. The reservation deposit is non-refundable and is applied toward the total collection price. With the studio’s agreement, the deposit may be transferred once to another available date or to another person. The remaining balance is payable on the portrait-session day.

3. Client cancellation

If the client cancels the booking, the reservation deposit will not be refunded. Any permitted transfer or rescheduling request must follow the conditions below.

4. Rescheduling

One reschedule is permitted when the studio receives at least 48 hours’ notice. The replacement date is subject to availability. Illness or an emergency may be handled through this rescheduling allowance. Further changes may be treated as a cancellation and may require a new deposit.

5. Late arrival

A late-arrival charge of RM100 applies for every commenced 30-minute period after the confirmed arrival time. A late arrival may also reduce preparation or photography time where extending the appointment would affect the studio schedule.

6. Studio cancellation

If A Poet’s House must cancel and cannot provide a suitable replacement date accepted by the client, the reservation deposit will be refunded.

7. Portrait selection and retouching

The client selects the 12 included portraits at the studio on the session day. Unselected and unretouched working images are not included. Up to two reasonable retouching revision rounds are included; requests outside the agreed portrait style or beyond those rounds may require a separate quotation.

8. Delivery and physical artwork

Digital portraits are normally delivered within 14 days after selection. Printed and framed artwork requires additional production time. Colour, surface and material may vary slightly between screens, fine-art prints and handmade frames.

9. Privacy and publication

Client information is handled under the Privacy Notice. Permission to publish portraits is requested separately, is optional, and is never a condition of booking.

10. Afternoon tea, allergies and dietary requirements

Afternoon tea and refreshments are complimentary and are not a separately customised catering service. The studio cannot currently accommodate specific dietary requirements or guarantee that food or drink is free from allergens. Items may be prepared by third-party suppliers or handled where milk, eggs, wheat or gluten, peanuts, tree nuts, soy, fish, shellfish and other allergens are present, and cross-contact may occur.

Clients must disclose known allergies, intolerances or dietary restrictions before the session. This allows the studio to discuss whether refreshments should be omitted, but does not mean an allergen-free alternative can be provided. A client with a serious allergy should not consume an item unless personally satisfied that it is safe. Parents and guardians are responsible for determining whether refreshments are suitable for a participating child.

11. Governing law and dispute resolution

These terms and all portrait services provided by A POET PHOTO HOUSE under the A Poet’s House brand are governed by the laws of Malaysia.

If a concern or dispute arises, the client should first contact official@apoethouse.com with the booking name, session date, a description of the concern and the preferred resolution. The parties agree to attempt to resolve the matter in good faith. The studio will acknowledge a formal complaint within three working days and aims to provide a substantive response within fourteen working days where reasonably possible.

If the matter cannot be resolved directly, either party may pursue any remedy available under Malaysian law. Where eligible, a consumer may submit a claim to the Tribunal for Consumer Claims Malaysia. Nothing in these terms removes or restricts a statutory right or remedy that cannot lawfully be excluded. Subject to applicable tribunal jurisdiction or another mandatory requirement, disputes requiring court proceedings will be submitted to the courts of Malaysia.

12. Professional review

These policies are a working commercial draft and are not a substitute for legal advice. Before public launch, a Malaysian-qualified legal professional should review the Personal Data Protection Act requirements, consumer rights, non-refundable deposits, rescheduling and late charges, portrait copyright and publication permissions, services involving children, food and allergy wording, cross-border data processing and dispute provisions.
